Description
The Utah State Board of Education intends to award a contract for the ACT college readiness assessment without using a standard procurement process. The supporting justification states that Utah law specifies the assessment most commonly submitted to Utah universities, and reports that ACT scores accounted for 83.7% of score reports sent to Utah colleges and universities in the 2025–2026 school year. ACT Education Corp. states that it owns or licenses the ACT assessment materials and that they must be ordered directly from ACT. This is a notice inviting other qualified vendors to challenge the proposed award, not a request for proposals, bids, or quotes. A challenge must identify the contesting person and provide a detailed explanation with supporting documentation showing competing sources; applicable evidence may include the ability to provide a comparable or equivalent assessment and, if relevant, a comparison of transition costs. Challenges must be submitted through the Utah Public Procurement Place portal.
