NOTICE TO CONTRACTORS BID ADVERTISEMENT DEPARTMENT OF WATER AND SEWER UTILITIES OF THE CITY OF NEWARK Sealed Bids will be received at 2:00 PM prevailing time, on Thursday, September 17, 2026 by the Department of water & Sewer Utilities, City of Newark, at City Hall, 920 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey in 1st Floor, Room 115, Procurement and Budget Unit, and there publicly opened and read aloud for the following: Pequannock Sludge Lagoon Remediation Contract No. 06-WS2026 The public opening of bids may also be accessed via MS Teams using the following link: http://tinyurl.comwaterpublicbidsopeningsnewark No bids will be received after the hour named. The Owner accepts no responsibility for any submittals of bids prior to their presentation at the date and hour indicated for the formal bid opening. The work consists of the dredging, removal and proper disposal of sludge from the 48 million-gallon (MG) capacity sludge lagoon that receives flows from the Pequannock Water Treatment Plant. The sludge lagoon is located approximately two miles away from the WTP and is situated adjacent to the Charlotteburg Reservoir. The project includes on-call services for the removal and disposal of sludge from the Pequannock Water Treatment Plant. The project includes the hauling and disposal of dewatered sludge cake from the Pequannock Residuals Treatment Facility, which will be performed on a weekly basis. Contract Documents may be examined and obtained at the Department of Water & Sewer Utilities, Division of Sewers and Water Supply, 1294 McBride Avenue, Little Falls, New Jersey during regular business hours. Copies of the Contract Documents may be obtained upon payment of a $100.00 (one hundred dollars) non-refundable fee made, with checks made payable to "The City of Newark". At the time Contract Documents are purchased, Contractors shall also be required to furnish a valid fax number to which all addenda can be directed (if necessary). Bidders will be furnished one set of Contract Documents for the deposit specified. Additional sets may be purchased for the deposit specified. No refunds will be given for the return of additional sets. Each Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by a Bid Security in the form of a bid bond, cashier's check, or a certified check made payable to the City of Newark in an amount equal to 10% of the amount of the total bid, but not exceeding $20,000. No Bidder may withdraw his/her Bid for a period of sixty (60) calendar days after the actual date of the opening of the Bids, except for reason covered under N.J.S.A. 40A:11-23.3. The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a surety company licensed in the State of New Jersey, and meets the requirements of N.J.S.A. 2A:44-143. Surety company shall also be listed on latest version of the U.S. Department of Treasury Circular 570. Complete instructions for filing Bids are included in the Instruction to Bidders. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. All bidders must comply with N.J.S.A. 40A:11-1, as amended relative to submission of a certification of the bidder, indicating the ability to perform the Contract. The bidder, in conformance with N.J.S.A. 52:25-24.2, shall submit with its bid, a statement setting forth the names and addresses of all stockholders who own ten percent (10%) or greater interest in the firm. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. The Bid is subject to New Jersey Local Public Contracts Law N.J.S.A. 40A:11-1 et. seq. Bidders must comply with N.J.S.A. 52:32.44 by proving a Business Registration Certificate prior to contract award. All proposals are subject to the requirements of all laws and City of Newark Ordinances affecting it. The bidder's attention is directed to SEC. 2:4-14 of the City of Newark Administrative Code. Bidders are also advised as to the applicability of the City of Newark's Affirmative Action Program. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq. and N.J.A.C. 17:27. In addition, the Contractor must certify that at least 25% of the total Contract bid price will be directed and paid to a minority business enterprise, either through joint venture arrangement, partnership, subcontractors, the purchase of goods and services or any other method available. The term "minority business enterprise" means a business at least fifty-one (51) percent of the stock of which is owned by a minority group member. "Minority group members" are citizens of the United States, who are Black, Hispanic, Asian American, Indians, Eskimos, and Aleuts. Successful bidders shall be required to attend a meeting with, and obtain clearance from the City of Newark's Office of Affirmative Action prior to execution of the contract. An additional seven percent (7%) of the Contract bid price will be directed ad paid to a woman's business enterprise, either through joint venture arrangements, partnerships, subcontractors, the purchase of goods and services or any other method available. The term "women's business enterprise" means a business where at least fifty-one (51) percent of the stock is owned by women. The Owner reserves the light to reject all Bids in accordance with N.J.S.A. 40A:11-13.2 and waive minor informalities. The Contract will be awarded to the lowest responsible and responsive bidder, in accordance with applicable law.
