Description
The New Mexico Department of Health is soliciting qualified legal professionals or firms to serve as outside counsel. The scope includes legal advice regarding agency operations; representation in administrative and judicial proceedings, hearings, arbitrations, employment, personnel, and labor disputes; civil litigation and case management; risk analysis; discovery and litigation planning; and travel for trials, hearings, and meetings as needed. Contractors must maintain official case files, coordinate with the Department's Office of General Counsel, disclose conflicts of interest, and provide initial risk analyses, quarterly status reports, and litigation risk analyses in agency-prescribed formats. Offerors must demonstrate experience representing governmental entities, including at least five years of general civil litigation experience for principals, and attorneys must hold or be able to obtain New Mexico Supreme Court licensure by assignment. The procurement may result in multiple awards, with a four-year contract term. Proposals must include separate electronic Technical and Cost Proposal uploads through the NMDOH Bonfire Procurement Portal; subcontracting is not allowed without prior written agency approval. Required response materials include the Letter of Transmittal, Campaign Contribution Disclosure Form, technical narratives and experience information, organizational references, financial-stability documentation, applicable preference certification, and the completed Cost Response Form.
