Millburn Township is considering Ordinance 2770-26, which would amend its development regulations and zoning ordinance to define “data center” and prohibit data centers in every zoning district. The proposed definition covers commercial colocation, cloud-computing, server farms, cryptocurrency mining, artificial-intelligence computing, high-performance computing, distributed computing, and wholesale digital infrastructure facilities. The ordinance would also establish exclusions for certain regulated utility and telecommunications facilities, incidental internal server or computer rooms meeting specified floor-area and electrical-capacity limits, and qualifying de minimis residential data-processing facilities. It would prohibit attempts to evade the restriction by dividing facilities among tenants, meters, lots, phases, ownership entities, or operating agreements, while authorizing the Zoning Officer to request information needed to determine whether a use qualifies as a data center. The ordinance would be referred to the Planning Board and would take effect upon final passage, adoption, and publication according to law.
