Description

The City of Banning is soliciting proposals from qualified entities or individuals to provide consulting services related to Community Facilities Districts (CFDs) and special districts. The scope of work includes assisting with the formation, implementation, and potential administration of CFDs, including bonded districts and service/maintenance districts, pursuant to the Mello-Roos Community Facilities Act of 1982. The selected consultant will also provide special district administration services, acting as an independent third-party consultant available on a continuing, short-notice basis to provide guidance and answer questions from City staff, property owners, and bondholders. The services required encompass a comprehensive range of activities. For CFD formation, this includes gathering information, developing a special tax methodology, preparing necessary documents, conducting infrastructure nexus analysis, coordinating bond financing, performing value-to-lien analysis, and assisting with acquisition agreements. For service and maintenance districts, the scope includes preparing special tax reports, ensuring direct benefit to the district, establishing sustainable escalators, and preparing boundary diagrams. The consultant will also be responsible for project team meetings, attending City Council meetings, and finalizing a special tax analysis report. Post-formation, the consultant will handle notice of formation, recordation of special taxes, and disclosure document preparation. Additionally, the consultant will provide ongoing special district administration services for existing CFDs and Improvement Areas. This includes program administration and compliance, parcel database and mapping management, annual levy and budget administration, tax roll preparation and direct billing, reporting and disclosure (including SEC Rule 15c2-12 via EMMA, CDIAC, and State Controller reports), delinquency and foreclosure administration, prepayment and bond administration, legal and legislative support, and customer service and technology support, including a software platform for City staff and stakeholders.
