Description
The Texas Comptroller of Public Accounts, acting on behalf of the Texas Prepaid Higher Education Tuition Board, seeks qualified independent attorneys or law firms to provide outside legal counsel on an as-needed, as-requested basis. Required expertise includes disclosure requirements for municipal fund securities, applicable FINRA and MSRB rules, federal tax-qualified tuition and savings plans, and related federal and state securities and tax matters. The scope may also include plan administration and governance, fiduciary responsibility, investment activities, intellectual property, administrative law, contracts, family law, probate, guardianship, trust law, Social Security, and Medicaid. Counsel must attend regularly scheduled quarterly Board meetings, provide rapid legal research and advice, invoice each plan separately, disclose conflicts of interest, and submit proposed attorney and paralegal rates. The initial contract term is December 1, 2026, through August 31, 2028, with two one-year renewal options. A completed VetHUB Subcontracting Plan, execution of the proposal form, and other proposal materials are required.
