ADVERTISEMENT FOR BIDS The Duluth Seaway Port Authority (Authority) will receive hand delivered bids at the Duluth Seaway Port Authority, Attention Dean Lembke, Facilities Manager, 802 Garfield Ave., Duluth, MN on THURSDAY, SEPTEMBER 10, 2026 at 11:00 a.m. CST for the DSPA ALTEC DULUTH EXPANSION project, at which time they will be opened and read aloud. All bids must be marked, “BID FOR: DSPA ALTEC DULUTH EXPANSION”, and shall be made on the proposal form contained in the specifications and shall be accompanied by a cashier's check, bid bond or certified check payable to the order of the Duluth Seaway Port Authority for not less than five percent (5%) of amount bid as liquidated damages and warranty that the successful bidder will enter into a contract. A pre-bid conference meeting will be held on August 25, 2026 at 2:00 p.m . at the offices of the Duluth Seaway Port Authority, 802 Garfield Ave., to discuss the scope of the project. Following the meeting interested parties will be able to access the project site at 1255 Port Terminal Drive. This project is funded by the Duluth Seaway Port Authority and is subject to the prevailing wage rates as set forth in the Specifications. The successful bidder must be a “responsible contractor.” The term “responsible contractor” means a contractor as defined in the Minnesota Statutes, section 16C.285, subdivision 3. Any prime contractor, subcontractor, or motor carrier that does not meet the minimum criteria or fails to comply with the verification requirements is not a responsible contractor and is not eligible to be awarded a construction contract for the project or to perform work on the project. A prime contractor, subcontractor, or motor carrier that makes a false statement under oath verifying compliance with the minimum criteria will be ineligible to be awarded a construction contract on the project, and the submission of a false statement may result in termination of a contract awarded to a prime contractor, subcontractor, or motor carrier that submits the false statement. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. Before execution of a construction contract, a prime contractor shall submit a supplemental verification under oath confirming that all subcontractors and motor carriers that the prime contractor intends to use to perform project work have verified to the prime contractor, through a signed statement under oath by an owner or officer, that they meet the minimum criteria for a responsible contractor. No Bidder shall modify, withdraw, or cancel his Bid or any part thereof for sixty (60) days after the time designated for the receipt of bids. The Authority reserves the right to reject all bids without explanation and to waive irregularities or to accept such qualifying bids as in the opinion of the Authority will be in the best interests of the Authority. Bidding and awarding of contracts are subject to the provisions of the Duluth Seaway Port Authority Purchasing and Contracting Policy Resolution No. 2-19. The successful bidder shall furnish performance and payment bonds in the full amount of the contract, and in accordance with Minnesota State Law and Resolution 51-89 of the Authority as required by the Specifications within ten (10) days of receipt of Notice of Award of Contract.
