The Texas Health and Human Services Commission is soliciting bids to establish one or more rebate contracts for milk-based and/or soy-based infant formula, excluding exempt infant formula, purchased through WIC programs. Bidders may bid on milk-based formula, soy-based formula, or both, and must identify a primary formula brand and rebate amounts for powdered, liquid concentrate, and ready-to-feed forms. Rebates will apply across the bidder's qualifying product line and will be adjusted based on changes to the manufacturer's lowest national wholesale full-truckload prices. The awarded contractor must maintain sufficient production and distribution capacity to supply WIC-approved vendors throughout Texas, Minnesota, Iowa, and the Choctaw Nation of Oklahoma; comply with applicable federal food and formula regulations; support supply-disruption and recall response requirements; and pay rebates based on monthly redemption invoices. The contract term is October 1, 2027, through September 30, 2032, with a possible extension of up to one year. The response must include pricing materials, affirmations, bidder qualifications and references, a wholesale price list, product-line information, and documentation demonstrating operational and financial capacity.
