Description
The Colorado Judicial Department, through the Office of the State Court Administrator, seeks one or more providers to coordinate and manage the Forfeiture Defense Counsel Fund created and governed by HB26-1250. The contractor will identify and qualify attorneys licensed and in good standing in Colorado, determine whether defendants meet specified indigency criteria, appoint counsel for civil asset forfeiture proceedings, rotate appointments equitably, and pay appointed attorneys in accordance with statutory requirements. The contractor must maintain attorney lists, support representation through the conclusion of proceedings, and provide at least quarterly reports covering appointments, case costs, fund balances, challenges in retaining counsel, and case outcomes. The anticipated agreement consists of a one-year initial term with four additional one-year renewals, not exceeding five years total. Funding distributed to the contractor may not exceed $500,000 per year, and the Department does not guarantee any level of spending. Appointed defense counsel generally may be paid up to $3,500 per case unless a court authorizes a higher amount. Proposals must address organizational resources, statewide access, indigency determinations, attorney recruitment and qualification, monitoring and complaints, case distribution, risk management, past performance, and pricing. The response must use the provided Submission Packet and include the requested evaluation responses and supporting business documents.
