BC Bid e-Bidding or Hard Copy Delivery to Prince George Timber Sales Office (2000 South Ospika Blvd., Prince George BC V2N 4W5). Applications must be received before the closing date and time. Bonus bid must be submitted electronically via BC Bid or by written tender in a sealed container marked 'Tender for Timber Sale Licence TA2871'. A completed 'Application and Tender for Timber Sale Licence' form is required. Applicants must be registered BC Timber Sales enterprises in Category 1 and Category 4. A bid deposit may be required in the form of an irrevocable standby letter of credit or cash/money order/bank draft/certified cheque payable to the Minister of Finance. All documents submitted are subject to disclosure under the Forest Act and Freedom of Information and Protection of Privacy Act. Applicants are responsible for checking BC Bid for any changes to the tender materials before the closing date. Submitting an application indicates acceptance of all terms and conditions. The successful applicant must enter into a timber sale licence within 10 business days of notification. All individuals directing work must be certified as SAFE Companies or equivalent. Applicants are encouraged to confirm their BCTS Enterprise registration status prior to applying. The upset stumpage rate is $0.25/m3. The estimated timber volume is 4455m3, more or less. The estimated area is 10.7 ha. Estimated species include Hemlock, Spruce, Douglas Fir, and Balsam. The licence term is 24 months. The successful applicant must implement and conform to the BC Timber Sales Environmental Management System and Sustainable Forestry Initiative standards. Changes to EMS and SFM programs due to the updated 2022 SFI Forest Management Standard may impact clients, including new training requirements. Applicants are advised that the Province does not warrant the licensee's right of unfettered access to the cutting authority area and will not be liable for injuries, losses, expenses, or costs incurred due to third-party actions or natural occurrences. The Province does not guarantee timber volume, species, or grade estimates. Applicants are advised to verify all timber volume estimates before submitting an application. Submitting an application indicates acceptance of all terms and conditions. The successful applicant must enter into a timber sale licence within 10 business days of notification. Failure to enter into the licence may result in actions authorized under Section 78 of the Forest Act and the BC Timber Sales Regulation. No right to cut Crown timber or occupy Crown land is conferred until an executed licence is obtained and operational plans are approved. A road permit or road use permit may be required. The Province makes no representations or warranties concerning the accuracy of timber volume estimates or the profitability of harvesting operations. Applicants are advised to verify all timber volume estimates before submitting an application. Submitting an application indicates acceptance of all terms and conditions. If the applicant is the Successful Applicant and is approved to enter into a timber sale licence, the applicant acknowledges and agrees that it will accept all the terms and conditions set out in the timber sale licence. Applicants must be registered as a BC Timber Sales enterprise in Category 1 (Market) and Category 4 (Value-added). The upset stumpage rate was determined in accordance with the Interior Appraisal Manual and applicable to coniferous sawlog grades. The successful applicant will be required to implement and conform to the BC Timber Sales Environmental Management System and this TSL also conforms to the standards of the following forest management certification system: Sustainable Forestry Initiative. Be aware that BCTS has made changes to its EMS and SFM programs to meet the updated 2022 Sustainable Forestry Initiative (SFI) Forest Management Standard. Changes impacting BCTS clients include new training requirements (Table 008-1, 0008-1A, Tailgate Training, SFI Awareness documents, and new Indigenous rights awareness information). In addition, note changes to EMS/SFM Environmental Field Procedures and Incident Reporting Procedures which occurred June 1, 2022. Supervisors and workers will need to get familiar with these changes prior to commencement of operations. INTRODUCTION. Pursuant to the Forest Act and to the BC Timber Sales Regulation, the timber sales manager invites applications for a timber sales licence (the "Invitation"). Terms not otherwise defined in these Process Rules or in the Forest Act and its regulations have the meaning given to them in the General Information tab within the BC Bid website. To be eligible to apply for a timber sales licence, an applicant must meet the following criteria (the "Eligibility Criteria"): a) the applicant must be registered as a BC timber sales enterprise and be a category of BC timber sales enterprise to which the Invitation has been made available; b) no circumstance which would constitute a deemed cessation of the applicant's registration as a BC timber sales enterprise pursuant to section 9 of the BC Timber Sales Regulation has occurred and is continuing; and c) the applicant has not ceased to be a BC timber sales enterprise. 2. PLACE, DATE AND TIME OF SUBMISSION OF APPLICATIONS. Applications must be submitted before the Closing Date and Time using one of the following submission methods (the "Submission Methods"): a) electronically, using the e-Bidding services of BC Bid; or b) by hard copy, delivered to the timber sales manager by hand, mail, or courier at the physical address location identified in the opportunity. The applicant is solely responsible for ensuring that, regardless of submission method selected, the timber sales manager receives a complete application, including all attachments or enclosures, before the Closing Date and Time. 3. APPLICATION PARTICULARS. An application must meet the following criteria ("Application Particulars"). It must: a) include an offer by the applicant to pay to the government, in addition to other amounts payable under the Forest Act and its regulations, for the following, as applicable: i. stumpage under Part 7 of the Forest Act; ii. waste assessments for merchantable Crown timber, whether standing or felled, that could have been cut and removed under the timber sale licence, but, at the licensee's discretion, is not cut and removed, and iii. a bonus bid or bonus offer, as required by the timber sales manager in the Invitation, in the amount tendered; b) include a tender for the bonus bid or bonus offer (as applicable). For applications made electronically, the bonus bid or bonus offer must be submitted using the e-Bidding services of BC Bid. For applications made by hard copy, the bonus bid or bonus offer must be submitted by written tender in a sealed container marked "Tender for Timber Sale Licence" followed by the applicable timber sale licence number; c) include a completed "Application and Tender for Timber Sale Licence" form. All statements made in the Application and Tender for Timber Sale Licence form must be true and correct. For hard copy applications, that form must be signed by the applicant. For proposals submitted via BC Bid, submission using a BCeID Signature constitutes the signature of the applicant; d) be prepared independently of other prospective bidders and be submitted to the timber sales manager by the applicant on their own behalf and not by any third party; and e) otherwise comply with every requirement in the Forest Act and the BC Timber Sales Regulation, and every requirement in these Process Rules and the Application and Tender for Timber Sale Licence. 4. MANDATORY CRITERIA. Applications which do not meet the following mandatory criteria ("Mandatory Criteria") will be excluded from consideration and will not be eligible for approval of a timber sales licence. Applications must: a) be made by a person who meets the Eligibility Requirements; b) be submitted using one of the Submission Methods; c) meet and comply with the Application Particulars; and d) be received at the Closing Location before the Closing Date and Time. 5. DEPOSITS. If required by the timber sales manager, an applicant must provide a bid deposit with an application, and must pay a deposit for a timber sale licence before entering into the licence. The amount and treatment of the deposit, and (where applicable) the applicant's eligibility to rely on a standing deposit will be determined in accordance with the BC Timber Sales Regulation. A deposit must be in one or more of the following forms: a) an irrevocable standby letter of credit: (i) issued in favour of the Minister of Finance by a Canadian chartered bank, credit union or trust company acceptable to the minister; and (ii) in the form provided or another form acceptable to the minister responsible for the Forest Act; b) cash, by money order, bank draft, or certified cheque, payable to the Minister of Finance. If an application is approved by the timber sales manager, before entering into the timber sale licence, the successful applicant is to submit the information in relation to the deposit in the form required by the timber sales manager. 6. CHANGES TO OR WITHDRAWAL OF APPLICATIONS. An applicant may amend or withdraw its application before the Closing Date and Time by submitting a clear and detailed written notice requesting withdrawal of its application using the same submission method by which the applicant originally submitted its application. Upon the Closing Time, all applications become irrevocable and may not be withdrawn. 7. RESERVATION OF RIGHTS. The timber sales manager reserves the right, at any time prior to the Closing Date and Time, and in its sole and absolute discretion, to: a) cancel the invitation for applications for the timber sale licence; or b) to supplement or amend any information or document provided in association with the Invitation. 8. PROCESSING OF APPLICATIONS. Applications which meet the Mandatory Criteria, and which have not been withdrawn ("Eligible Applications"), will be opened at or about the Opening Date and Time at the Opening Location. 9. EXAMINATION OF APPLICATIONS. Before approving any Eligible Application, the timber sales manager may take steps to confirm that an application meets the requirements of an Eligible Application, is bona fide and may require an applicant to provide: a) information related to the applicant's achievement in satisfying primary performance and financial performance criteria; b) proof of the applicant's identity; c) proof of the applicant's registration as a BC timber sales enterprise; d) proof that the applicant continues to meet each of the requirements of the BC Timber Sales Regulation for registration; and e) proof that the applicant has not ceased to be a BC timber sales enterprise. The timber sales manager may reject an application under section 81 (3) of the Forest Act or refuse an application under section 81 (5) of the Forest Act, and such rejected or refused applications will not constitute Eligible Applications and will not be eligible for approval of a timber sale licence. 10. APPROVAL OF APPLICATIONS. The timber sales manager must approve the Eligible Application of the applicant whose proposed bonus bid or bonus offer is the highest of those tendered by all applicants with Eligible Applications (the "Successful Applicant") unless, at the direction of the minister, the timber sales manager has been directed to not approve any of the Eligible Applications. If the Successful Applicant does not enter into a timber sale licence, the timber sales manager may approve the Eligible Application of the applicant whose proposed bonus bid or bonus offer is the next highest of those tendered by all applicants with Eligible Applications (which person will become the Successful Applicant), or may decline to approve any of the Eligible Applications. The timber sales manager will inform the Successful Applicant of the approval of its Eligible Application and provide other information, including whether the applicant is a level 1, level 2, or level 3 applicant and the amount required to be submitted as a deposit or, if a standing deposit is to be relied upon, the requirement to complete the deposit declaration. 11. ENTERING INTO LICENCE. If an Eligible Application is approved, the Successful Applicant must enter into a timber sale licence with the timber sales manager within 10 business days of being provided notice of the obligation to do so by the timber sales manager. 12. FAILURE TO ENTER INTO LICENCE. Where an Eligible Application is approved and the Successful Applicant does not enter into the timber sale licence within 10 business days of being provided notice of the obligation to do by the timber sales manager, the timber sales manager may do any or all of the things authorized under Section 78 of the Forest Act and the BC Timber Sales Regulation with respect to that failure. 13. OCCUPATION AND HARVESTING RIGHTS. No right to cut Crown timber or to occupy Crown land is conferred by reason only that an application is approved. The occupation of Crown land or cutting or removal of Crown timber may only be authorized through an executed timber sales licence following approval of operational plans under the Forest and Range Practices Act and by the payment, in full, of the deposit or any amount tendered in the application and then owing. 14. ROADS The Successful Applicant, on entering into the timber sale licence, may be required to apply for and obtain a road permit for the construction and maintenance of a road or a road use permit for the use of a Forest Service Road, as applicable. 15. DISCLOSURE OF INFORMATION All documents submitted to the Province will become the property of the Province, and will be subject to the disclosure in accordance with section 136.1 of the Forest Act and the Freedom of Information and Protection of Privacy Act. 16. FURTHER INFORMATION. Further information about this Invitation may be obtained through the Official Contact. Despite access rights and obligations which may be conferred through a timber sales licence or associated road permit(s) or road use permit(s), applicants are advised that the Province does not warrant nor has it ever warranted a licensee's right of unfettered access to the cutting authority area including access impeded by the actions of third parties (including through acts of civil disobedience) or natural occurrences. The Province will not be liable to the applicant for any injuries, losses, expenses, or costs incurred or suffered by the applicant as a result, directly or indirectly, of an act or omission of any third party, including but not restricted to an act or omission of a person disrupting, stopping or otherwise interfering with the applicant's operations associated with the licence by road blocks or other means. b) Cruise Accuracy and Estimate of Timber Volume. The timber volume advertised through this Invitation estimated by way of a timber cruise is based on a small sample of the cutting authority area. The cruise sampling error stated in the Appraisal Summary Report applies to the total volume of timber on the cutting authority area and therefore, the variation in timber volume estimates for individual species and grades may be higher or lower than what is indicated by the sampling error. In addition, the estimated timber volumes are based on taper equations and loss factor tables that may not reflect local conditions. Applicants are advised to verify all timber volume estimates in this Invitation before submitting an application. The Province does not guarantee timber volume, species, or grade estimates. The "estimated volumes of timber", advertised through this Invitation, are prepared through field examinations. The Province makes no representations or warranties concerning the accuracy of the estimates or concerning the profitability of timber harvesting operations to be carried out under the licence. Applicants are advised to verify all timber volume estimates in this Invitation before submitting an application. Regardless of either the method of estimating timber volumes, or the sampling error of the timber cruise, the Province does not guarantee timber volume, species or grade estimates. 18. ACCEPTANCE OF TERMS AND CONDITIONS. Submitting an application indicates acceptance of all the terms and conditions set out in these Process Rules and the Application and Tender for Timber Sale Licence and confirms the applicant's intent to be bound by them. If the applicant is the Successful Applicant and is approved to enter into a timber sale licence, the applicant acknowledges and agrees that it will accept all the terms and conditions set out in the timber sale licence. The preceding volume and species estimates are based on samples from a Full Cruise. Please see tender package for additional detail.
