Description
The United Nations Development Programme is procuring specialized legal and technical consulting services to support Brazil's National Water and Basic Sanitation Agency in evaluating whether and how to regulate the subdelegation of public sanitation services. The scope covers water supply, wastewater collection and treatment, urban cleaning, and municipal solid-waste management, including subdelegation through public-private partnerships. The work must assess applicable laws and existing regulatory reference standards, identify regulatory gaps and conflicts, analyze national and international benchmarks, and evaluate legal, institutional, operational, economic, financial, tariff, user-service, oversight, and risk-allocation impacts. The contractor must deliver six reports: a detailed work plan; a national and international benchmarking report; technical and legal materials for a public consultation and analysis of contributions; a regulatory and legal diagnosis; an economic and financial impact analysis; and materials supporting a regulatory impact analysis. The proposal requires a Portuguese-language technical offer, methodology, execution schedule, key personnel, qualifications, company experience, supporting certificates and attestations, curricula vitae, and a separate financial offer. The six deliverables are scheduled over a total execution period of 290 days, followed by 15 days for administrative closeout. The technical proposal is limited to 10 pages for the methodology section and is evaluated together with the financial proposal using a 70% technical and 30% financial weighting.
