Description
The Export-Import Bank of the United States intends to award a sole-source follow-on contract for recovery services on specified claims in Mexico. The contractor will investigate and pursue collection of amounts owed by debtors and guarantors, including asset searches, credit analysis, negotiations, restructuring agreements, and, when directed, litigation and enforcement against assets. The work requires qualified local counsel familiar with the Mexican judicial system and registered to perform legal work there. The performance work statement calls for an initial recovery plan and estimate, preliminary case research, an attempt at extrajudicial collection within 90 days, and legal proceedings if directed and collection is unsuccessful. It also describes reporting and ongoing performance evaluation. Compensation includes a 15% contingency fee on actual cash recoveries; filing fees are handled through a separate contract modification.
