Notice of Agreement Between the Commonwealth of Massachusetts and OpenCape

The Information Technology Division (ITD) and the Executive Office for Public Safety and Security's (EOPSS) entered into an agreement with OpenCape Corporation for the purchase of an indefeasible right to use fiber on the backbone broadband network to be built by OpenCape. OpenCape owns, has rights in, has constructed or is planning to construct, a fiber optic communications system, an integrated microwave communications system, a regional collocation center, and associated property along a route spanning the length of Cape Cod, among other areas. The Commonwealth is empowered under the agreement to offer the fiber to municipalities as well as state agencies. The rights granted to the Commonwealth under this Agreement have a fair market value of $5,000,000.
